Recommendations
- The offering of illegal gratification should be made a substantive offense.
- The maximum imprisonment should be for the same should be increased under section 165 of the Indian Penal Code, 1860
- Section 237, CrPC should be amended to provide for the trial of cases.
- Sec 164 of Crpc should apply to the presidency towns of Bombay, Calcutta, and Madras.
- Sec 337 of CrPc should be amended to permit the court to tender pardon to an approver.
- Sec 422 of CrPC – the state governments should be requested to issue executive instructions to the District Magistrate to inform the L.G. Special Police Establishment of notices of appeals in S.P.E Cases.
- Section 3, 4, and 5 of the Prevention of Corruption Act should be amended so that the officers down to the rank of inspectors are empowered to take cognizance of and investigate certain offenses without prior order of the Magistrate where there is a severe risk of weak evidence being lost.
- Delhi Special Police Establishment Act 1946 should be amended too.
- Section 147 of the Indian Railways Act 1890 should be amended.
- The special police establishment should not take over the functions of the Directorate of Enforcement under the Ministry of Commerce and Industry.
- Machinery should be evolved for the speedier disposal of departmental proceedings.
- The special police establishment should be continued for a time to come as it has justified its existence.
